Buying on the coast as a foreigner: how the trust works in the restricted zone

One of the first questions of a foreign buyer interested in the Yucatán coast is legitimate: can I, as a foreigner, own a beachfront property in Mexico? The short answer is yes —and the figure that makes it possible is called a trust (fideicomiso).

What the "restricted zone" is
The Mexican Constitution establishes a restricted zone: the 50 km strip from the coast and 100 km from the borders. Within it, a foreigner cannot acquire direct ownership of land in the traditional way. Since Sisal and the Yucatán coast are within that strip, this rule applies.
But "not in the traditional way" doesn't mean "it can't be done." It means it's done through a figure designed precisely for this.
The trust: ownership with backing
A trust (fideicomiso) is a contract in which a Mexican bank (the trustee) holds legal title to the property for the benefit of the foreign buyer. In practice, the beneficiary:
- Uses, enjoys, rents, remodels, sells and inherits the property.
- Has all the rights of an owner, in writing.
- Has the backing of a regulated banking institution.
It's a common, well-established figure, used by thousands of foreigners who have invested on Mexico's coasts.
Why it provides certainty (not complexity)
Far from being an obstacle, a well-structured trust is an additional layer of security: clear rules, a formal institution involved and rights defined from the start.
What matters is not just having a trust, but that the development is correctly structured from the outset —with the trustee, the permits and the property regime in order— before selling.

For an international investor, the best signal isn't a promise of returns: it's a solid legal structure. When legal certainty is a given, buying on the Yucatán coast stops being a bet and becomes a well-made decision.
